“Customer” means any person who shall take any services, advice, information from ZEXFRET LTD.

“Collection” means any goods that are collected from customers for the purpose of the parcel.

“Storage” means any goods that are shipped to the destination country as a parcel.

 

SECTION 2- ACCEPTANCE OF TERMS

IN THESE TERMS AND CONDITIONS, “WE”, “US”, “WEBSITE” AND “OUR” REFERS TO ZEXFRET LTD. ZEXFRET LTD OPERATES THE WEBSITE “www.zexfret.com”. YOUR ACCESS TO AND USE OF ALL INFORMATION ON THIS WEBSITE INCLUDING PURCHASE OF OUR SERVICE/S IS PROVIDED SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS.

SECTION 5- ACCEPTABLE USE POLICY

Services provided by us may only be used for lawful purposes. You agree to comply with all applicable laws, rules, and regulations in connection with your use of the services. Any material or conduct that in our judgment violates this policy in any manner may result in suspension or termination of the services or removal of the user’s account with or without notice.

 

5.1. Prohibited Use

You may not use the services to publish content or engage in activity that is illegal under applicable law, that is harmful to others, or that would subject us to liability, including, without limitation, in connection with any of the following, each of which is prohibited under the law:

  • Phishing or engaging in identity theft
  • Distributing computer viruses, worms, Trojan horses, or other malicious code
  • Distributing pornography or adult related content or offering any escort services
  • Promoting or facilitating violence or terrorist activities
  • Infringing the intellectual property or other proprietary rights of others

5.2. Enforcement

Your services may be suspended or terminated with or without notice upon any violation of this policy. Any violations may result in the immediate suspension or termination of your account.

SECTION 6- RIGHT TO REJECT REQUEST FOR SHIPPING SERVICE

ZEXFRET LTD reserves the right to reject any request for shipping at its sole discretion. Without limitation, any shipment containing any item that is considered a restricted article or hazardous material by the International Air Transport Association (IATA) will not be shipped by ZEXFRET LTD. Shipments containing items that cannot be transported legally or safely, include, but are not limited to:

  • Animals
  • Plants
  • Chemicals
  • Perishables
  • Currency
  • Precious Metals
  • Explosives
  • Perfume
  • Precious Stones
  • Liquor
  • Negotiable items in Bearer Form

Moreover, Customers are also not allowed to carry LIQUID into the packages. If any customer puts any hazardous or liquid goods without prior written notice to ZEXFRET LTD before collection, he will be liable for his goods that damage to other parcels inside the container and will pay the cost of damaged items to the full extent.

 

SECTION 7- FREE FLAT BOXES

  1. Customers can claim free flat boxes for packaging by requesting us by the following link:

  2. Customers shall deposit £50 for an empty box that is to be sent to him and the rest of the amount shall be paid by the customer before Collection. If any customer fails to ship the box in between 60 days, such a deposit shall be automatically considered as the purchase of the box.

 

SECTION 8- COMMERCE PACKING

  1. Customers shall pay £20 for professional packing of their parcel. For more information see section 16 (5).
  2. Customers shall be charged £5 for wrapping up their parcel. Notwithstanding any packed parcel, if we at our sole judgment think fit for security, we find your unwrapped parcel should be wrapped, we will wrap it and charge £5 per parcel.

 

SECTION 9- RECEIVER’S NAME CHANGE

To change the receiver’s name, the sender shall pay £7 and contact us by the following link:

SECTION 10- FREE STORAGE PERIOD

Customers shall enjoy 7 days of the free storage period in the destination country. However, ZEXFRET LTD reserves the right to charge demurrage fees of £3 a day per item; £10 a day for vehicles, and a discretionary percentage for any valuable item.

 

SECTION 11- INSURANCE

ZEXFRET LTD offers optional insurance cover. Insurance cover shall cost 20% of the total declared value. If the customer does not take insurance coverage and any loss or accident happens, ZEXFRET LTD shall cover only £50 and no claim shall be made under such circumstances.

 

SECTION 12- PAYMENT

  1. Customers shall make payment immediately after booking for AIR PARCEL SHIPMENT.
  2. Customers shall pay 60% of the total cost of SEA PARCEL immediately after the invoice is raised, the rest amount shall be paid within 28 days from the date on which the invoice was raised.

 

SECTION 13- LATE PAYMENT FEE

Customers shall pay the LATE PAYMENT FEE if any unpaid balance after the due date. The LATE PAYMENT FEE shall be £20 or 10% of the unpaid balance, whichever is higher.

 

SECTION 14- EXTRA FEES CHARGE

Customers shall be charged some extra fees regarding some particular customs and shipment issues.

 

14.1. AIR PARCEL

  1. Customers must pay the DRC Customs fees in order to send electronic goods via Air. They shall be charged £10 per mobile phone and £20 per computer. Nevertheless, you are requested to declare the content inside your parcel. If you want to parcel other electronic devices, please contact us at info@zexfret.com.
  2. We consider volumetric weight for any Air Cargo or Express Courier. The chargeable weight of a shipment is based on either the actual physical weight of a parcel or the volumetric weight of the parcel whichever is larger. The volumetric weight of a parcel is based only on its size.

 

14.2. SEA PARCEL

  1. Customers shall be charged £2 on top of Sea parcels exceeding allowed weight (i.e., size of a small box, medium box and big-box are respectively 30 Kg, 50 Kg, and 80 Kg).
  2. Customers shall pay an extra charge on the basis of the volume of the extra dimensions if the size of regular dimensions exceeds.

 

SECTION 15- SAFETY

  1. Customers are recommended for safety purposes to put not more than one-fourth of fuel in their fuel tanks of vehicles that are being shipped on the container.
  2. Customers must make sure that any items that are generators or similar to generators; the tank of such items are completely empty from fuel for safety purposes.

 

SECTION 16- LIABILITY AND DISCLAIMERS

  1. ZEXFRET LTD shall take responsibility for the customer’s goods from the day of the Collection of the goods from the customer to ship the goods in the Storage to the destination country.
  2. Customers are acknowledged to provide a signature, proof of ownership of any shipped car, or any valuable item such as logbook, invoice, or at least 50% of the advance deposit for any shipment.
  3. It is the responsibility of the customer to collect the parcels that are shipped to the destination’s Storage. Any goods that are not collected from our Storage in terms of 60 days; valuable items such as vehicles, machines, that are not self-possessed by the customers in between 90 days shall be considered as ABANDONED ITEMS. ABANDONED ITEMS shall be sold to redeem all expenses incurred in its shipment and storage. If you have any complaints regarding this issue, please contact our “Milton Keynes Office” by calling +44 (0) 74 2400 4550. All complaints shall be accepted. The customer shall be received a letter by ZEXFRET LTD regarding the issue of disposal of any ABANDONED ITEMS without any legal action. After the said period above no claim shall be kept into account and the customer shall get the rest amount after excluding the expenses.
  4. We also parcel TV on the full responsibility of the shipper. In most cases such as 80% of the cases, TVs arrive completely unscathed. There are, however, to some extent 20% of the cases TVs may found with broken screens. You must contact us before parcelling a TV and sign our “TV Shipping Agreement” where you shall agree on shipping your TV after acknowledging all risks and shall not make ZEXFRET LTD liable for any of your loss.
  5. Customers are allowed to use their boxes instead of ours. Customers shall at their own risk pack their own goods, nevertheless, they will be responsible for their unprofessional/bad packaging. ZEXFRET LTD shall not be liable for any loss that is happened by unprofessional/bad packaging and shall not give any compensation for such loss. However, customers are advised to check the cost using our automatic calculator on our website to decide if they want to send it or not. After collection, if they want to reject the charged cost; they will be charged collection fees and they shall make their own arrangement to collect their shipments from our warehouse. Customers shall request this in writing and make payments accordingly before their request can be accepted. They shall be also charged to search and find their boxes.
  6. ZEXFRET LTD is not liable for acts and omissions by third parties, such as, but not limited to carriers, warehousemen, stevedores, port authorities, and other freight forwarders unless ZEXFRET LTD has failed to exercise due diligence in selecting, instructing, or supervising such third parties. Nevertheless, Customers must claim a parcel at destination city immediately on delivery or at the Collection in our office. ZEXFRET LTD shall not accept any claim made after delivery or consignee collection.
  7. ZEXFRET LTD MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO DELIVERIES OR WITH REGARD TO THIS WEBSITE, INFORMATION PROVIDED ON THIS WEBSITE, OR SERVICES RELATED TO TRANSACTIONS CONDUCTED ON THIS WEBSITE. ZEXFRET LTD CANNOT GUARANTEE DELIVERY BY ANY SPECIFIC TIME OR DATE. IN ANY EVENT, ZEXFRET LTD SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR INCOME, WHETHER OR NOT ZEXFRET LTD HAD KNOWLEDGE THAT SUCH DAMAGES MIGHT BE INCURRED.

 

 

SECTION 17- CANCELLATION

  1. Customers are required to cancel any appointed booking of Collection that is made over the phone, online, or via any other social media platform such as WhatsApp, Facebook, and others prior to 48 hours. Otherwise, customers shall be charged for missed appointment fees or late cancellation charges that shall be calculated based on the measures already undertaken or expenses incurred by ZEXFRET LTD. (This charge cannot be less than £20)
  2. Customers shall be required to deposit £500 for a VEHICLE booking in which £300 is non-refundable in case of cancellation after booking.

 

SECTION 18- FORCE MAJEURE

Any delay or failure of performance caused by an occurrence beyond the control of any party (ZEXFRET LTD or Customer) affected, including, but not limited to, acts of governmental authorities, acts of God, the discovery of materially different site conditions, wars, riots, rebellions, sabotage, fire, explosions, accidents, floods, strikes, lockouts, or changes in laws, regulations, or ordinances. In the event that a party intends to invoke this force majeure provision, that party shall provide prompt notice to the other party as soon as possible after the occurrence of the event giving rise to the claim of force majeure.

 

SECTION 19- INDEMNITY

Customers agree to indemnify, defend and hold harmless ZEXFRET LTD and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third-party.

 

SECTION 20- SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

SECTION 21- TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

 

 

SECTION 22- GOVERNING LAWS

These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the Laws of England and wales.

 

SECTION 23- CHANGES

ZEXFRET LTD reserves the right to make updates, changes, or modifications to this Terms and Conditions anytime. Customers are expected to check these Terms and Conditions every time they visit this website.
